Work permit type B in Poland — management board member, commercial proxy, general partner
Work permit type B is needed when a foreigner joins a company's management board, becomes a commercial proxy or a general partner and will perform that function for more than six months in any 12-month period.
The application is filed by the Polish company, not by the manager themselves. The portal is praca.gov.pl; the decision is issued by the voivode. This is not MOS and not a residence card: the right to stay is arranged separately.
The fee is the same as for type A: 200 PLNif the function is assigned for up to 3 months, or 400 PLNif longer. Without the voivode's decision the management-board function cannot be performed for that term.

What a type B work permit is
Type B is about running a company, not about ordinary work under an employment contract. If the person works in a Polish firm as an employee, that is almost always type A. If they are on the management board or are a commercial proxy and the function lasts more than six months in a year — we look at type B.
The company is also checked on income and headcount: income of at least 12 average salaries in the voivodeship and at least two full-time employees who do not need a separate work permit. There is also another path — showing funds, investment, job creation. The voivode looks at the figures in the accounts, not at wording in the application.
A residence card for business is a neighbouring but different procedure: there the applicant is often the foreigner themselves, the account is MOS. Type B does not replace a residence card.

How the company obtains a type B permit
The application is filed electronically on praca.gov.pl, from 1 June 2025. The form is ZC-WWZ; the applicant is the company that assigns the function. The voivode may ask for explanations and documents on income, employment and powers in the KRS register.
Processing time is a guide of about a month, up to two in complex cases, from a complete application. The decision must be given to the foreigner — both on grant and on refusal.
If the company is young or the type B income and headcount conditions are not yet met, the permit is often issued for a year, not for three.

Who needs a type B permit
Type B is needed by a Polish company (or a branch) that wants a foreigner on the management board for more than six months in any 12.
If the function is shorter, type B may not be needed — but then the powers cannot be stretched after the fact. If in practice this is ordinary work under a contract, and the person was entered in KRS only on paper, the voivode may treat it as a façade and refuse.
The foreigner does not file type B for themselves.
Income, headcount and the term of the function
The basic set: the function for more than 6 months in any 12 and company income of at least 12 times the voivodeship average salary and at least two full-time employees who do not need a work permit. Or — the path provided by law through funds, investment and jobs.
Most often the pack stalls here: in KRS the person is already a board member, but the tax and ZUS picture does not meet the threshold. We talk about this before filing, not after a refusal.
Type A pay rules (comparison with colleagues, a quarter-time post) do not transfer directly to type B: the subject of the check is different. Refusal for a sham, arrears and being on the undesirable-persons list is possible here too.

What the voivode checks for type B
The voivode looks at powers in KRS, whether the function is real, the income figures, two employees (or the investment path), ZUS contributions and taxes — and whether the board exists only for the sake of entry.
Grounds for refusal are close to type A: false data, penalties for illegal assignment of work, the undesirable-persons list, a start later than 12 months, permit caps if they have been introduced.
We do not assemble headcount and turnover «for the application». If the B conditions are not met now, we will say which path is realistic.

Who the applicant is
The applicant is the company that assigns the function, not the foreigner «in their own name». A representative may file under a power of attorney.
The foreigner does not start performing a type B function until there is a permit.
What happens after the decision
You give the decision to the manager. Stay is arranged next: visa, card, MOS. Type B itself does not issue a residence card.
Changing conditions or an extension are separate applications, not an edit in MOS. If in parallel you need an employee post in the same firm, that is already type A, not an add-on to B.
